Association Governance & Membership
The community is governed by the Chase Run Homeowners Association, a California nonprofit mutual benefit corporation.
All Lot owners are automatically Members of the Association.
The Association is managed by a Board of Directors.
The Governing Documents include this Declaration (CC&Rs), the Articles of Incorporation, Bylaws, and Association Rules.
Assessments & Common Areas
Owners are obligated to pay assessments (Regular, Special, Emergency, Special Individual) as levied by the Association. These funds cover common expenses, including the maintenance of Common Areas and facilities.
Assessments are due as specified by the Board (e.g., quarterly installments for Regular Assessments).
Unpaid assessments can become a lien against the Owner's Lot and may incur late charges, interest, and collection costs.
The Association owns and maintains the Common Areas (e.g., specific designated lots, private alley, drainage facilities) for the use of the Members.
Owner Responsibilities
Owners must maintain their individual Lots and Residences in good condition and according to the standards set forth in the Governing Documents and any provided Maintenance Manuals.
Owners must comply with all provisions of the CC&Rs and other Governing Documents.
Owners are responsible for obtaining insurance for their own Residences.
Architectural Control
An Architectural Review Committee oversees modifications to properties.
Owners must obtain prior written approval from the Architectural Review Committee before making any alterations, additions, or significant changes to the exterior of their homes or landscaping (including structures, fences, paint colors, solar panels, satellite dishes, etc.). This ensures changes are harmonious with the community design and comply with guidelines.
Use Restrictions & Community Rules
Lots are restricted to Single Family Residential Use.
Business activities are generally restricted, although home offices may be permitted under specific conditions that do not impact the residential character of the community.
Nuisances that disturb the peace or safety of the community are prohibited.
Specific rules apply regarding pets, parking (including restrictions on RVs, trailers, etc.), vehicle maintenance, trash disposal, signs, noise levels, window coverings, and outdoor equipment.
Owners are responsible for the conduct of their family members, tenants, and guests.
Rental Policy
Owners have the right to lease their Residences.
All leases must be for the entire Residence and must be in writing.
The minimum lease term permitted is one hundred and eighty (180) days. Rentals for periods shorter than 180 days (short-term rentals; e.g. Airbnb) are not permitted.
Lease agreements must state that the tenancy is subject to the Association's Governing Documents.
Tenants are required to comply with all Association rules and regulations. Owners remain responsible for ensuring tenant compliance.
Enforcement
The Association has the authority to enforce the Governing Documents.
Enforcement actions may include notices, hearings, imposing monetary penalties (fines), suspending privileges (excluding the right to vote on certain key issues), and pursuing legal action if necessary.
